May 23, 2016

A meeting of the Wayne County Board of Supervisors was held on the 23rd day of May 2016, in the Board Room of the Wayne County Courthouse, Corydon, Iowa, pursuant to notice of meeting subject to Iowa Code Section 21.4.  The Board noted due notice of meeting subject to said Code Section.

Present were David Dotts, Duffy Kester, John Sellers, members of the Board of Supervisors.

Unless otherwise noted, all motion were approved unanimously.

Sellers made the motion, Dotts seconded to approve the Agenda.

Sellers made the motion, Dotts seconded to approve the minutes of the May 2, 2016, and May 19, 2016.

The Board refused to approve the minutes of the May 10, 2016, as published, with Dotts noting they needed more information from the Seymour Herald.  The Board later requested that to be corrected and republished.

Dotts made the motion, Sellers seconded the motion to approve the claims as submitted.

Sellers made the motion, Dotts seconded to open the Public Hearing in regards to the Amendment of the Current Budget.

It was noted that no oral or written comments were present.

Sellers made the motion, Dotts seconded to close the Public Hearing.

Sellers made the motion, Dotts seconded to approve the Amendment to the Current Budget as published.

Dotts made the motion, Sellers seconded to approve and adopt Resolution 05-23-2016, a Resolution pertaining to the Amendment of Current County Budget for the fiscal year ending June 30, 2016.

Dotts made the motion, Sellers seconded to approve and adopt Resolution 05-24-2016, a Resolution authorizing the appropriations for expenditures for the various County Offices and Departments for the fiscal year ending June 30, 2016.

Dotts made the motion, Sellers seconded to approve the renewal of Heritage 1865 liquor license.

Trevor Wolf, County Engineer, was present with reviewed work on bridges, rural road pot holes and driveways.  It was noted that they soon would begin work on the bridge on Cedar Road and that it would be closed for about three (3) months.  Wolf also noted that the pavement patch was to begin June 23rd with a completion date of October.  Wolf stated that he was going to get quotes on two (2) pickups, dozer and excavator, with the Board requesting three (3) quotes.  There also was an update in regards to the railroad crossing west of Seymour.

Alan Wilson, County Attorney, Kim Swearingin, County Treasurer, Kay Middlebrook, County Assessor, Caleb Housh, Mayor City of Seymour and Dale Housh, Seymour Industrial and Development Corp. There was a review of the minutes of the Supervisors meeting on May 4, 2015, in regards to the request to abate the taxes on the Seymour Care Center. In that meeting Kester made the motion to approve the County’s share of the taxes with Housh, stating that they would request the same from the School District and the City of Seymour. Swearingin stated that the County did not have the authority to just abate part of the taxes, that is required a total abate of taxes or compromise of the taxes with an agreement. Middlebrook stated that with the City owning the property it would become tax except, but that option would not be available until the 2016 tax cycle. Wilson stated that he was under the understanding that Housh was to provide additional paper work at the time, with Housh stating that he did not recall that but was willing to provide any that would be required or needed. Housh explained that they City of City had purchased the Seymour Care Center with the intent to sell the property or turn in over to the Seymour Industrial & Development Corp, in the hopes that it be sold and placed back on the tax rolls and would like to have the taxes abated. There was a discussion in regards to the requirements of Iowa Code Chapter 445.63. Dotts made the motion, Sellers seconded the motion that if the City of Seymour in writing requested that the last of the taxes due for 2014 and all of those due for the year 2015, as required by Iowa Code 445.63, the County would abate said taxes. The Board later noted that a letter had requesting that the taxes be abated as requested.

Kim Swearingin, County Treasurer, was present in regards to Lot 167 in the City of Humeston, parcel # 01150F378002, assigning tax certificate, the total taxes due are $310.10, including the cost of the 90 day notice. Swearingin recommendation to the Board was to try and recoup the cost of the 90 day notice leaving a total tax due of $129.00. The Board directed her to visit with the person involved.

An Agreement from Harland Technology Services to provide IT Manager Net Admin Service for the Data Processing Department in the amount of $12,,860.00 annually. Sellers made the motion, Dotts seconded to approve and sign the Agreement for Harland Technology Services.

Kester stated that he felt the Board should move forward with the quote of Midwest Alarm Services for the Wayne County Voice dialer with an annual cost $775.28, after some discussion Sellers made the motion, Dotts seconded to approve and accept the quote for the services in the amount of $775.28.

It was noted that Devon Garden and Shannon Ritter had been hired as part-time Jailer/Dispatchers effective May 11th & 12th, 2016, at an hourly rate of $13.06.

The monthly reports of the Wayne County Clerk of Court and Kim Swearingin, County Treasurer, were approved and filed.
